Construction Prequalifications

The purpose of competitive bidding is to ensure fairness, efficiency, and security in the construction of public facilities .Competitive bidding statutes were enacted for the benefit and protection of the public and not for the benefit of the bidders. 

Pre-Qualification (Pub. Cont. Code 20111.6)

The bill requires a school district with ADA over 2,500 to prequalify bidders for construction contracts awarded on or after January 1, 2014 if (1) the contract value is $1,000,000 or more, and (2) the project is funded, in whole or in part, with State bond funds. In addition, the prequalification forms used by the district must cover, at a minimum, the issues covered by the model forms developed by the California Department of Industrial Relations ("DIR").

 Contractor Registration (SB854)

All contractors and subcontractors intending to bid or perform work on public works projects will be required to meet minimum qualifications and register (and annually renew) online for the program. The DIR will post a list of registered contractors and subcontractors on its website.

Sub-Contractor License AB44

Effective July 1, 2014, AB 44 requires the inclusion of the California contractor license number for each subcontractor submitting a bid or performing work on public works projects.
